BizIn – KFC Palopo City Branch, South Sulawesi, was sued for IDR 4 billion by its customer, Erwin Sandi, to the Palopo District Court. It was following allegations of public deception due to orders that did not match the application.
The lawsuit in the form of a breach of contract to the Palopo District Court, has been registered on the official website of the Palopo District Court with case number 3/Pdt/G/2022/Pn Plp. As a plaintiff, Erwin said on Thursday (13/1), the customers are officially filing a civil lawsuit because an open apology cannot be carried out by them (KFC Palopo management).
The lawsuit refers to Article 62 paragraph 1 of Law Number 8 of 1999 concerning Consumer Protection with a fine of Rp. 2 billion. The plaintiff also demanded immaterial losses of IDR 2 billion to the defendant KFC Palopo.
In addition, Erwin also sued the online transportation service provider company (Go-jek), both the company and its partners (drivers) not for fines but for improving their services. This is related to the problem when the hamburger order for his child did not match the picture in the application that was delivered by an online driver on November 15th 2021.
The food he received was not equipped with mayonnaise, vegetables, and sauce like in the application. Likewise, a similar order also does not match with the application on November 13th 2021.
There was a mediation process with the management of KFC Palopo, with four points of demands. Such as an open apology, need to improve customer service like not sell incomplete meals, feeding the orphans every Friday at least five orphanages in Palopo for one month, and did not fire the employees for the incident.
But only three were realized, demands for an open apology through the media were not realized. Erwin also explained that they only want to apologize privately and not openly. The victim is not only me, but many people.
Area Manager of KFC Palopo, Darman told reporters that he could not comment much regarding the issue with the lawsuit. They would hand it over to the company’s legal counsel for legal assistance.
